1. Agreement
By creating an account or using CYA Moment (“the Service”), you agree to these Terms of Service and to the Privacy Policy referenced in them. If you do not agree, do not create an account or use the Service.
Terminology.Within these Terms of Service and the Privacy Policy referenced in them, “case” refers to the data container the Service uses to group related incidents, evidence, and records belonging to a single user. In the product interface, a case is labeled “CYA” (plural “CYAs”). The terms are interchangeable; “case” is used in this document for legal clarity.
2. Eligibility
You must be at least eighteen years old and legally able to form a binding contract in your jurisdiction. You may not use the Service if you are barred from doing so under applicable law.
3. Legal Name Attestation
At signup you attest that the first and last name you provide are your true legal names. Because the Service is designed for evidentiary use, your legal name is locked once stored and cannot be edited from the application. False attestation is grounds for account termination and may compromise the evidentiary value of records you create.
4. Account Security
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us promptly of any unauthorized access.
5. Acceptable Use
You agree not to use the Service to harass, defame, or harm others; to upload unlawful content; to attempt to access another user's account or data; or to interfere with the operation of the Service.
6. Your Content
You retain all rights in the content you upload. You grant us only the rights necessary to operate the Service for you: storing, processing, and displaying your content within your account, generating exports you request, and sharing it with collaborators you explicitly invite.
7. Evidentiary Value
We maintain timestamps and integrity controls to support the evidentiary use of records. We make no guarantee that any record will be admitted as evidence in any proceeding; admissibility is determined by courts and tribunals applying applicable rules.
8. Subscriptions and Billing
Paid features are billed in advance through our payment processor. You may cancel at any time; cancellation takes effect at the end of the current billing period and does not entitle you to a refund of amounts already paid except where required by law.
9. Termination
You may delete your account at any time. We may suspend or terminate accounts that violate these Terms. On termination, your data is removed per the Privacy Policy retention rules.
10. Disclaimers
The Service is provided “as is” without warranties of any kind. We are not a law firm and the Service does not provide legal advice. Consult a qualified professional for legal questions.
11. Limitation of Liability
To the maximum extent permitted by law, our total liability arising out of or related to the Service is limited to the amounts you paid us in the twelve months preceding the claim.
12. Changes
When we change these Terms we increment the version and require re-acceptance for new account creations. Existing accounts retain the version they accepted unless the change requires re-acceptance.
13. Governing Law
These Terms are governed by the laws of the jurisdiction in which the operating entity is registered, without regard to conflict-of-laws principles.
